The instant writ petition has been filed, seeking a writ of mandamus, commanding respondent no.3 to decide the Case No.T202105440404625 (Rishikesh vs. Darshan) , under Section 35 of the Land Revenue Act, within the stipulated time.
I have perused the records. The mutation case was filed by the petitioner in the month of February, 2021 wherein opposite parties have put in appearance. Copy of the order-sheet has been annexed as Annexure- 3 to the writ petition to demonstrate that the case is not proceeding expeditiously.
In view of the facts and circumstances of the case, without expressing any opinion on the merits of the case, this petition is disposed of with the direction to respondent no.3 to decide the aforesaid proceedings to its logical conclusion, as expeditiously as possible, preferably within a period of 6 months, from the date of production of a certified copy / computer generated copy of this order before the authority concerned, without granting unnecessary adjournments to either of the parties.
