Heard Sri Manoj Kumar Maurya, counsel for the petitioner, Sri Sudhir Bharti, counsel for respondent no.3 and the learned standing counsel for respondent nos. 1 & 2 through V.C.

The instant writ petition has been filed, seeking a writ of mandamus, commanding respondent no.1 to expedite the proceeding of Case No.00852 of 2018 (Computerized Case No.T201805440500852) (Saraswati Devi vs. Dharmendra Kumar Singh), under Section 116 of the U.P. Revenue Code, 2006, within the stipulated time.

I have perused the records. The petitioner has filed a suit under Section 116 of the U.P. Revenue Code, 2006 in the year 2018 wherein the opposite parties have put in appearance as well as the reports were also submitted in the case. Copy of the order-sheet has been annexed as Annexure-4 to the writ petition to demonstrate that the case is not proceeding expeditiously.

In view of the facts and circumstances of the case, without expressing any opinion on the merits of the case, this petition is disposed of with the direction to respondent no.1 to decide the aforesaid proceedings to its logical conclusion, as expeditiously as possible, preferably within a period of 8 months, from the date of production of a certified copy of this order before the authority concerned, without granting unnecessary adjournments to either of the parties.
