Heard Sri Diwakar Prasad Shukla, counsel for the petitioner, the learned standing counsel for respondent no.1 and perused the records.

The instant writ petition has been filed, seeking a writ of mandamus, commanding respondent no.1 / Tehsildar Gola, Gorakhpur to decide Case No.1289 of 2001-02 (Computerized Case No.T201705310703488) (Ram Adhar Shahi vs. Pranpati Shahi), under Section 34 of the U.P. Land Revenue Act, 1901, within the stipulated time.

The petitioner filed a case for mutation under Section 34 of the U.P. Land Revenue Act in the year 2000. Copy of the order-sheet annexed with this petition, clearly demonstrates that the case is pending since 2000 in the court of Tehsildar and is not proceeding expeditiously.

In view of the facts and circumstances of the case, without expressing any opinion on the merits of the case, this petition is disposed of with the direction to respondent no.1 to decide the aforesaid proceedings to its logical conclusion, as expeditiously as possible, preferably within a period of 3 months, from the date of production of a certified copy of this order before the authority concerned, without granting unnecessary adjournments to either of the parties.
