Heard learned counsel for the petitioner and learned Standing Counsel for the State.

Petitioner's claim for payment of compensation under Mukhyamantri Kisan Evam Sarvhit Beema Yojna stands rejected by The Oriental Insurance Company Limited.

Aggrieved thereby, the petitioner made a representation before the District Magistrate, Etawah which is stated to be pending.

Learned Standing Counsel points out that under the scheme District Level Committee headed by District Magistrate is empowered to take decision in the matter.

Accordingly, without expressing any opinion on merit of the claim of the petitioner, we dispose of the writ petition with direction to respondent no.1 i.e. District Magistrate, Etwah to place the matter before the District Level Committee, who may take appropriate decision in accordance with law, preferably within six weeks from the date of production of true attested copy of this order.

The writ petition is accordingly disposed of.
