The instant writ petition has been filed for restraining the respondents from constructing road through the petitioner's plot without following due process of law and to decide his application dated 18.09.2021.
On 10.12.2021, Coordinate Bench of this Court has passed the following order :-
"Contention is that without any acquisition or consent on part of the petitioner, Authorities of State are unauthorizedly constructing road on petitioner's bhumidhari land over plot no.346 area 0.441 hectare situated in Village Sarauna, Pargana & Tehsil Mariyahu, District Jaunpur. Learned Standing Counsel prays for and is allowed 10 days' time to obtain instructions.
Post this matter once again, as fresh, on 22.12.2021."
When the matter is taken up today, learned counsel for the petitioner has made statement at the bar that upon passing of order dated 10.12.2021, the respondents have removed the construction material from the plot of the petitioner and as such no grievance is now left.
In view of the above statement, nothing further survives to be decided in the instant matter.
The petition stands disposed of.
