Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.

The petitioner claims that he is Dhangar - Scheduled Caste and has applied for issuance of certificate in this regard before the Tehsildar, Tehsil Koil, District Aligarh by means of application dated 17.11.2021. It is also his case that in the past an enquiry was held and a report was submitted by the Enquiry Officer (Vigilance), Directorate of Backward Classes, Lucknow opining that 'Dhangar' is scheduled caste. The submission is that still the third respondent, before whom application has been filed, is sitting tight over the matter.

A Coordinate Bench of this Court on 10.12.2021 granted time to learned Standing Counsel to obtain instructions and apprise the Court as to what final decision has been taken in the matter.

On matter being taken up today, learned Standing Counsel states that according to the instructions furnished by the respondents, the petitioner has wrongly treated the enquiry report as an order. It is not disputed by learned Standing Counsel that till date application filed by the petitioner has not been disposed of by respondent No.3. It is also not disputed that respondent No.3 is the competent authority to take decision on the said application.

Accordingly, without expressing any opinion on merits, the writ petition is disposed of with direction to respondent No.3 to take decision on the application of the petitioner for grant of caste certificate in accordance with law expeditiously, preferably within twelve weeks from the date of receipt of a true attested copy of the instant order.
