Petitioner has instituted Suit No. T-202205440103210 against Janardan Pal and Anand Kumar. In that she has also applied for grant of stay in the nature of status quo. While such application has remained pending since May, 2022, the petitioner is being threatened with eviction.

Once the petitioner has approached the Court in the month of May, 2022 with a request for grant of stay, more than sufficient time has passed since then. The stay application ought to have been dealt with and appropriate order should have been passed thereon.

In view of the above, no useful would be served in keeping the writ petition pending or calling for any counter affidavit.

The writ petition is disposed of with a direction that in case, petitioner files a copy of this order before respondent no. 3 within a month, the said respondent shall fix a date to hear the petitioner's application in the above described suit and pass appropriate and reasoned order as expeditiously as possible preferably within a period of one month from the compliance is shown by the petitioner.

For a period of two months from today or disposal of stay application noted above, whichever is earlier, status quo as on date over the property in dispute, shall be maintained.
