Heard learned counsel for the petitioner, learned Standing Counsel accepted notice on behalf of respondent nos. 1 to 3 and Shri Sudhir Bharti, learned counsel accepted notice on behalf of respondent no.4.

In view of the order proposed to be passed, notices need not issue to the private-respondents.

The petitioner has preferred the present petition inter-alia with the prayer to issue a mandamus directing the Additional Commissioner (Administration) Fourth Gorakhpur Mandal, Gorakhpur (Respondent no. 1) to decide the Appeal No. C- 20210500000115 (Draupadi Devi and others vs. Punam Devi and others) District Kushinagar within stipulated period.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Additional Commissioner (Administration) Fourth Gorakhpur Mandal, Gorakhpur (Respondent no. 1) to consider and decide the aforesaid appeal in accordance with law expeditiously and preferably within a period of six months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
