Heard learned counsel for the petitioner, learned Standing Counsel for respondent Nos. 1 & 8 and Sri Sudhir Bharti, learned counsel for the respondent No2/Gaon Sabha. After some arguments, learned counsel for the petitioner confined his prayer only to the effect to direct the Sub Divisional Officer, Salempur, District Deoria to decide Case No.2520 which was filed by the petitioner expeditiously and as per direction given by the Board of Revenue Allahabad vide its order dated 17.11.2021 passed in Revision/Case No.REV/28/2013-2014 (Computer Case No.AL20130531991373) (Sanjay Kumar Vs. Gaon Sabha).

Learned counsel for the respondents have no objection to the prayer made by learned counsel for the petitioner.

Heard learned counsel for the parties.

With the consent of learned counsel for the parties, this petition is disposed of directing the Sub Divisional Officer, Salempur, District Deoria to decide the aforesaid case as per direction given by the Board of Reveue Allahabad in its order dated 17.11.2021 expeditiously and preferably within a period of six months from the date of production of certified copy of this order, if there is no legal impediment and after providing opportunity of hearing to the parties concerned.

At this stage, learned counsel for the petitioner further augured

that in the aforesaid revision filed by the petitioner against the order dated 10.02.2014, an interim protection was granted by the Board of Revenue and both the petitioner are handicapped and they have no other source of livelihood except the land in question and prays that the same be continued till the disposal of the case.

In the special facts and circumstances of the case, interim mandamus is issued restraining the respondents to interfere in the peaceful possession o the petitioner over the plot in dispute till the disposal of the case as stated above or till 31.12.2022 whichever is earlier.
