Heard Sri Viveka Nand Rai, learned counsel for the petitioners and Sri Abhishek Shukla, learned Additional Chief Standing Counsel appearing for the State respondents.
The present petition has been filed seeking a direction to the respondent no. 2/ Additional Commissioner Judicial (First), Commissioneri Varanasi Division, Varanasi to decide the Revision No. 107 of 2004, Computerized Case No. C2004140000328 (Ghinahu vs. Surya Prakash), within a stipulated period.
It is submitted that a revision arising out of proceedings under Section 229-B of the U.P. Z.A. & L.R. Act, 1950 was filed by the respondent nos. 3 to 5, in which the petitioners are contesting respondents and the matter is pending since long.
Counsel for the petitioners has referred to the order sheet of the case which has been filed along with this petition to contend that although various dates have been fixed for hearing but for some reason or the other the matter is being adjourned and the delay in disposal of the said case is causing undue hardship to the petitioners.
Learned Standing Counsel appearing for the State-respondents has no objection to the prayer so made.
Having regard to the aforementioned facts and circumstances, the present petition is disposed of with an observation that in case the petitioners appear before the respondent no.2 and do not seek any unnecessary adjournment, it is expected that the respondent no.2 would make an endeavour to decide the aforesaid case in accordance with law expeditiously, preferably within a period of six months from the date of presentation of a certified copy of this order, provided there is no other legal impediment.
