Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
It is argued by learned counsel for the petitioner that though an order dated 3.6.2021 has been passed in favour of the petitioner by the respondent no. 2 - Sub Divisional Magistrate, Sadar, District - Maharajganj in a proceeding under Section 34 of the U.P. Revenue Code, 2006 registered as Case No. 05005 of 2021 (Computerized Case No. T202105470105005) (Rambha Devi & others vs. Suresh & others) but the same has not yet been complied with.
Learned Standing Counsel has placed a report of the Revenue Inspector dated 25.6.2021, copy of which is annexed as annexure-3 to the writ petition, in which it is stated that after demarcation of land, stone pillars have been put on the land, as per the order dated 3.6.2021.
At this stage, learned counsel for the petitioner states that the report dated 25.6.2021 is only a paper work and the order dated 3.6.2021 passed by the respondent no. 2 has not yet been complied with in its letter and spirit.
Considering the facts and circumstances of the case, the writ petition is disposed of permitting the petitioner to file a representation ventilating all her grievances along with all relevant documents in support of her claim and a certified copy of this order before the respondent no. 2 - Sub Divisional Magistrate, Sadar, District - Maharajganj within two weeks from today. In case, any such representation is made, the respondent no. 2 shall consider and decide the same in accordance with law within eight weeks from the date of making of the representation, after giving opportunity of hearing to all concerned.
