Heard learned counsel for the petitioner and Sri Shashank Shekhar Singh, learned counsel for the respondents.

Present petition has been filed with the following prayer:-

"(i) Issue a writ, order or direction in the nature of mandamus commanding the respondent no.2 to grant admission to the petitioner to the B.A. LLB 2021-22."

Sri Shashank Shekhar Singh, learned counsel for the respondents-University has produced the instruction dated 14.2.2022, which is taken on record.

Sri Shashank Shekhar Singh, learned counsel for the respondents-University on the basis of instruction has made two folds submissions; firstly he submitted that candidature of petitioner has been rejected on the ground that she has not uploaded N.C.C. certificate and secondly he submitted that even if, last candidate provided admission in that category have obtained 39.25 marks whereas petitioner has obtained 35.75 marks, therefore, in case of non rejection of her candidature, she would not be able to get admission as she obtained lesser marks.

At this stage, learned counsel for the petitioner submitted that for redressal of her grievance, petiitoner has sent representation through mail dated 19.12.2021 to the Controller of Examinations, Aligarh Muslim University, Aligarhrespondent no.2, but till date no reply/decision has been given by the respondent no.2. Lastly, he submitted that a suitable direction may be issued to the respondent no.2 to decide the representation of the petitioner sent through mail dated 19.12.2021 at the earliest.

Accordingly, the writ petition is disposed of with direction to the respondent no.2 to decide the representation of the petitioner sent through mail dated 19.12.2021 strictly in accordance with law maximum within a period of two weeks from the date of production of certified copy of this order. Petitioner is given liberty to file hard copy of representation sent through mail dated 19.12.2021 before the respondent no.2.

It is made clear that Court has not adjudicated the case on merits and it is upon the respondent no. 2 to decide the aforesaid application of the petitioner after considering the relevant Acts, Rules, Statutes of the University, Judicial pronouncement made by the Court as well as facts of the case.
