Heard Sri Sanjeev Kumar Shukla, holding brief of Sri Gaurav Kumar Chaturvedi, learned counsel for the petitioner and Ms. Shivi Mishra, learned Standing Counsel for the State respondents.

The present petition has been filed seeking a direction to the respondent no.2-Tehsildar, Tehsil Nizamabad, District Azamgarh to decide the Case No. 574 of 2007-2008 (Hareram vs. Bihari) under Section 34/35 of the U.P. Land Revenue Act, 1901, within a stipulated time period.

Pursuant to the previous order, a report dated 17.09.2022 has been received from the respondent no.2 wherein it is indicated that the mutation case has remained pending for the reason that the parties have not filed the necessary evidence despite time having been granted for the same. It is also stated that 18.10.2022 is the next date fixed for evidence and that efforts are being made for early disposal of the case.

Having regard to the aforementioned facts and circumstances and without expressing any opinion on the merits of the case, the present petition is disposed of with an observation that the court below would make an endeavor to decide the aforesaid case in accordance with law, expeditiously preferably within a period of three months from the date of production of certified copy of the instant order, without granting any unnecessary adjournments to either of the parties, provided there is no other legal impediment.
