Heard learned counsel for the petitioner and Sri K. R. Singh, learned Chief Standing Counsel for the respondent-State.

In view of the order proposed to be passed, notices need not to be issued to the private respondent.

The only prayer made by counsel for the petitioner is for a direction to respondent no.2-Tehsildar, Jamaniya, District Ghazipur to decide the Case No.T202114290302855 of 2021 (Ram Sati Devi Vs. Mohd. Akmal Siddiqui) filed under Section 34/35 of U.P. Revenue Code, 2006 expeditiously within a stipulated period.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the petition stands disposed of finally with a direction to the respondent no.2 to consider and decide the aforesaid case, expeditiously, in accordance with law but certainly after giving opportunity of hearing to the parties concerned without granting unnecessary adjournment to either of the parties, except upon payment of cost provided there is no legal impediment.
