The instant petition has been filed for a mandamus directing the Collector, Gautam Buddh Nagar (respondent no. 3) to execute the recovery certificate no. 3504 dated 29.03.2022 in a sum of Rs. 1,82,32,870/- pursuant to order of respondent no.2 (U.P. Real Estate Regulatory Authority) dated 27.10.2021.
Learned Standing Counsel appearing on behalf of respondent no.3 on instructions states that the recovery certificate has been recently received in the office of respondent no.3 and that citation to appear had already been issued. She states that further action will be taken expeditiously.
Having regard to the above statement, we dispose of the writ petition with direction to Respondent no.3 to ensure that the recovery citation stated to have been issued in pursuance of recovery certificate dated 29.03.2022 be enforced expeditiously in accordance with law provided there is no legal impediment.
The writ petition stands disposed of accordingly.
