Learned Senior Counsel for the petitioners has submitted that the parties entered into Family Settlement dated 22.8.1991 and filed compromise under Section 9-A(2) of the U.P. Consolidation of Holdings Act and the same was decided in terms of compromise dated 22.8.1991 by the order dated 29.8.1991. The parties were put in possession as per the compromise. After 20 years of the order passed by the Consolidation Officer dated 29.8.1991, Digvijay Singh, Sudhir Singh, Smt. Gulabi Devi and Smt. Bailiya Devi filed an appeal No.1818 before the Consolidation Officer in respect of land situated in five villages, which was allowed on 03.12.2015. Since the order dated 03.12.2015 was exparte against Lal Bahadur Singh, petitioner no.1, he filed restoration application dated 15.12.2015 before the Settlement Officer Consolidation, which was dismissed by the order dated 04.5.2017. Lal Bahadur Singh and Smt. Neha, petitioner nos. 1 & 3, filed a joint Revision No.980, which was dismissed by the order dated 31.7.2017. The aforesaid orders were challenged before this Court in Writ-B No.45455 of 2017, wherein interim order is operating and it is pending.
