Heard learned counsel for the parties and perused the record.

The instant petition has been filed inter alia for the following relief :

"(i) To issue a writ of mandamus, order or direction in the nature of mandamus commanding the respondent No. 2- Settlement OfÏcer of Consolidation (Nai Ikai), Jaunpur to firstly decide the preliminary objection of the petitioner dated 14.10.2022 before proceeding to decide the appeal no.2 (Ramraji Vs. Mangla) under section 109-A (3) U.P. C.H. Act."

It is submitted that the aforesaid objection is pending since 14.10.2022. However, Settlement OfÏcer of Consolidation (Nai Ikai), Jaunpur is not taking any fruitful steps to decide the aforesaid appeal.

Learned Standing Counsel has no objection in case a direction is issued for early disposal of the case.

No useful purpose would be served by keeping this matter pending, therefore, this Court deems it appropriate to finally dispose of the present writ petition, without entering into the merits of the case, with a direction to the Settlement OfÏcer of Consolidation (Nai Ikai), Jaunpur (respondent no.2), before whom the application/objection dated 14.10.2022 (Annexure-1) filed by the petitioner is pending disposal, to decide the same first before passing any final order on the revision, expeditiously, preferably, within the period of six months from the date of receipt of a copy of this order.

It should be decided by a reasoned and speaking

order, in accordance with law, after affording opportunity of hearing to the parties concerned without granting unnecessary adjournments.

With the aforesaid observations, present writ petition is disposed of.
