Heard learned counsel for the petitioner and leaned Standing Counsel appearing on behalf of State-respondents.
The petitioner is aggrieved by the order dated 28.10.2022 passed by respondent no.2, Collector, Bijnor, rejecting his application dated 27.5.2022 for transfer of Revision No. 445 under Section 48 U.P.C.H. Act from the court of Deputy Director of Consolidation, Bijnor, to some other court.
From the perusal of impugned order, it appears that the revisional court had been fair enough to send its comment to the Collector stating that it has no objection in case the revision is transferred to some other court, but the Collector has chosen to trust the Deputy Director of Consolidation and directed him to decide the same within one month.
Learned counsel for the petitioner submits that justice should not only to be done, but ought to be seen to have been done. Without making any adverse comment on the Deputy Director of Consolidation and the Collector, Bijnor, is left open for Collector, Bijnor, to consider the possibility of sending the case to some other officer for decision in accordance with, within a period of one month.
The writ petition is disposed of.
