Order on Civil Misc. Impleadment Application
An impleadment application has been filed by Sri Ram Singh, Advocate praying for impleadment of Naraina, son of Shankarwa, as respondent no. 5 in the writ petition. He has submitted that an order was passed against the grand-mother of respondent no. 5, Smt. Sumiriti, on 04.02.1981 by the Consolidation Officer, hence respondent no. 5 is a necessary party in the writ petition.
Counsel for the petitioner submits that the order has attained finality since it was never challenged during the pendency of consolidation proceedings by Shankarwa or his grand-mother. Now after the closure of consolidation proceedings, it is not open for him to approach this court for seeking any relief against the order dated 04.02.1981 of the Consolidation Officer.
Hence, the impleadment application is rejected.

An affidavit of compliance and exemption application has been filed by Sri Rana Pratap, Consolidation Officer, Banda.
Counsel for the petitioner admits that the relief prayed in the writ petition has been granted to him.
In view of the above, the writ petition has become infructuous. It is accordingly, dismissed as infructuous.
Order on Civil Misc. (Exemption) Application
In view of the fact that no order is further required to be passed in the petition personal appearance of the aforesaid officer is exempted until further orders.
