Heard Mr. Laloo Yadav, learned counsel for petitioner and Mr. Narendra Singh, learned counsel for respondents-1 to 4.

Petitioner has approached this Court for a writ of mandamus commanding respondent-2, to issue joining letter to the petitioner for the post of Constable (GD) pursuant to CAPFS Examination-2018.

At the very outset, learned Standing Counsel for respondents-1 to 4 contends that during course of identification of credentials of petitioner, some variation was found. His finger expressions have been taken and sent for verification to Central Print Bureau and Central Forensic Science Laboratory.

Mr. Laloo Yadav, learned counsel for petitioner has then invited the attention of Court to the order dated 06.05.2022 passed in Writ A No. 3725 of 2022 (Km. Kamal Kumari Vs. Union of India and 3 others) . For ready reference, same is reproduced herein under:

"Heard Mr. Laloo Yadav, learned counsel for the petitioner and Mr. Sanjeev Kumar Rai, learned counsel for the respondents.

By means of the present writ petition, the petitioner has prayed for a direction upon the respondents to issue the joining letter to the petitioner of the post of Constable (GD) in CAPFS Examination-2018 and given him one opportunity for selection.

Learned counsel for the petitioner submits that the petitioner has submitted his application form in respect of SCC GD (Constable in CAPFS, NIA, SSF and Riflemen In Assam Rifles Examination-2018 pursuant to which he was issued E-Admit Card for appearing in Written Examination (computer based examination), which was to be held on 22nd February, 2019. The result of the written examination was published on 26th April/21st June, 2019 in which the petitioner was declare successful. The Physical Standard Test/Physical Efficiency Test for constable (GD) in CAPFS for the year 2018 has also been conducted between 13th August, 2019 to 25th September, 2019, in which the petitioner participated and qualified. Thereafter the petitioner participated in detail medication examination which was held on 28th January, 2020. In the said medical examination, the petitioner qualified.

As the petitioner has qualified all the stage of examinations of Constable (GD)-2018 and the result was declared on 21st January, 2021, but no appointment letter for joining on the said post has been issued to the petitioner till date despite the fact that more than one year and three months have elapsed from the date of declaration of final result to be precise on 21st January, 2021.

On the basis of instructions so received by him, learned counsel for the respondents submits that the process of verification of identity of the petitioner is going on and for completion of the same, at least three months will be required and thereafter the appointment letter shall be issued to the petitioner.

In view of the aforesaid, this writ petition is disposed of by providing that the authority concerned i.e. Director General, CRPF (Recruitment Board), East Block 07, Level-04, Sector-01, R.K. Puram, New Delhi/Director General, Sashastra Seema Bal (SSB), East Block, V. R.K. Puram, New Delhi (respondent no.3/respondent no.4) to ensure that the process of verification of the identity of the petitioner is completed within three months from the date a certified copy of this order is filed before him and appointment letter for joining on the post in question is issued to the petitioner thereafter, if there is no other legal impediment.

Considering the issue involved in the present writ petition, at this stage, this Court is of the view that no useful purpose shall be served in keeping this writ petition pending.

In view of above, this writ petition is disposed of finally by providing that the authority concerned Director General, Sashastra Seema Bal (SSB), East Block, V. R.K. Puram, New Delhi (respondent no.3/respondent no.4) shall ensure that the process of verification of the identity of the petitioner is completed within three months from the date of presentation of a certified copy of this order and appointment letter for joining on the post in question is issued to the petitioner thereafter, if there is no other legal impediment.
