Heard Sri Sudhanshu Kumar Singh, learned counsel for the petitioner, learned Standing Counsel for respondent nos. 1 and 2 and Sri Ashok Kumar Singh, learned counsel for the respondent nos. 3 and 4.

The instant writ petition under Article 226 constitution of India has been filed for direction to the respondent to appoint the petitioner under compensate ground under Uttar Pradesh Recruitment of Dependents of Government Servant Dying-in-Harness Rules, 1974.

It is contended by counsel for the petitioner that brother of the petitioner Avnish Pratap Singh was died on 22.08.2017 while working as Assistant Teacher in Prathmik Vidyalaya Dayalpur, Vikas Khand Dumariyaganj, District Siddharth Nagar. After his death, the petitioner has applied for compensate appointment in his place. The District Basic Education Officer, Siddharth Nagar vide letter dated 17.12.2021 informed the petitioner that no post of class-III is vacant and as such if he is interested he may be appointed on Class-IVth post. In reply to the said letter, the petitioner submitted his application dated 10.02.2022 alongwith an affidavit on the ground that he is ready to accept the post of Anuchar (Class-IVth) but till date no order has been passed on the petitioner's application for appointment on compensate ground on the post of ClassIVth.

Learned counsel for the respondent nos. 3 and 4 on the basis of instructions submits that the decision in this regard be taken by the District Basic Education Officer, Siddharth Nagar-respondent no.4 within a period of two months and no useful purpose would be served in calling for the counter affidavit and keeping the writ petition pending.

Under the circumstances, this writ petition is disposed of

with a direction to the respondent no. 4/District Basic Education Officer, Siddharth Nagar to decide the petitioner's application as expeditiously as possible, in accordance with law, by a reasoned and speaking order preferably within a period of two months from the date a certified copy of this order is filed before him.
