Heard learned counsel for the petitioner and learned Standing Counsel for the State.

By means of this writ petition, the petitioner has prayed for quashing impugned order dated 22.1.2022, passed by Director General, Police Training College, Moradabad.

A further prayer to direct respondents 2 and 3 to evaluate the veracity and seriousness of the allegations as found levelled against the petitioner in the F.I.R. dated 11.7.2020 and examine the same in the light of judgment in the case of Avtar Singh and thereby a direction to the respondents to ensure to join the petitioner as Sub Inspector, Civil Police.

Learned counsel for the petitioner submits that although, the impugned order dated 22.1.2022 was passed by Director General, Police Training College, Moradabad, however, till date, no final decision with regard to services of the petitioner has been taken by respondent No.3.

Learned Standing Counsel though has opposed the petition, however, on the basis of written instructions received by him, does not dispute the fact that final decision is yet to be taken.

The petitioner's counsel submits that it would suffice in case a direction is given to respondent No.3 to take a final decision in the matter.

On due consideration to the argument advanced, perusal of the record and considering the prayer of the petitioner as also the instructions received by learned Standing Counsel, the petition is finally disposed of with direction to the competent authority to take final decision in the case of the petitioner in the light of the law laid down in Pawan Kumar versus Union of India and another decided on 2.5.2021 and Avtar Singh versus Union of India and others passed in Special Leave Petition (C) No.20525 of 2011 on 21.7.2016, by passing a speaking and reasoned order within a period of two months from the date of receipt of a certified copy of this order.
