Heard learned counsel for petitioner and learned Standing Counsel for respondents.

Petitioner has sought a mandamus commanding respondents to open seal cover and promote him on the post of Head Constable on ad-hoc basis in view of Clause-10 of Government Order dated 28.05.1997.

Para-10 of Government order dated 28.05.1997 reads as under:

"(10) चयन सममिमति दቛኋरቛኋ ्ቚथमि बቛኋर आररोपमति कቛኋममिरक ककी ्ቚरो्ቐमति पर मविचቛኋर करनने एविवं मिमुहर बन्द ललिफቛኋफने ककी ्ቚमቅኌयቛኋ अपनቛኋयने जቛኋनने कने बቛኋद एक विरर ककी अविलधि बबीति जቛኋनने पर भबी इस अविलधि मिम ऐसबी आगमणिति नहीሻ ककी जቛኋयनेगबी लजसमिम अपचቛኋरबी कቛኋममिरक दቛኋरቛኋ अविध्यቛኋन कने कቛኋरणि जቛኋवंच ्ቚमቅኌयቛኋ मिम मविलिम्ब हहआ। यमद आररोमपति कቛኋममिरक कने मविरय मिम ्ቚशቛኋसनቛኋलधिकरणि ककी जቛኋवंच मविभቛኋगबीय कቛኋयरविቛኋहबी/अमभयरोजन कቛኋ अनन्तिमि पररणिቛኋमि ्ቚቛኋ्቎ न हहआ हरो, तिरो ऐसने कቛኋममिरकोሗ कने मविरय मिम , जरो मनलिनम्बति नहीሻ हह / चयन सममिमति दቛኋरቛኋ मनम्नललिलखिति ्ቚमतिबन्धिोሗ कने सቛኋथ तिदथर आधिቛኋर पर ्ቚरो्ቐमति कने सम्बन्धि मिने मविचቛኋर मकयቛኋ जቛኋयनेगቛኋ।"

क. आररोमपति कቛኋममिरक कने मविरु्ቍ लिगቛኋयने गयने आररोप क्यቛኋ इतिनने गम्भबीर हह मक

उनकने आधिቛኋर पर उसने भमविष्य मिम भबी ्ቚरो्ቐमति सने विवंमचति रखिቛኋ जቛኋनቛኋ उपयमु्ሹ / जनमहति मिम हरोगቛኋ।

खि. क्यቛኋ ्ቚशቛኋसनቛኋलधिकरणि ककी जቛኋवंच / मविभቛኋगबीय कቛኋयरविቛኋहबी अमभयरोजन कने अनन्तिमि पररणिቛኋमि ्ቚቛኋ्቎ हरोनने मिम कቛኋफकी समिय लिगनेगቛኋ।

ग. ्ቚशቛኋसनቛኋलधिकरणि ककी जቛኋवंच / मविभቛኋगबीय कቛኋयरविቛኋहबी अमभयरोजन मिम हरो रहने मविलिम्ब कने ललिए ्ቚत्य्ቌ यቛኋ पररो्ቌ रूप सने आररोमपति कቛኋममिरक तिरो दरोरबी नहीሻ हह।

घ. आररोपमति कቛኋममिरक करो तिदथर ्ቚरो्ቐमति मदयने जቛኋनने पर विह अपनने पद कቛኋ दमुरुपयरोग अथविቛኋ जቛኋवंच करो कमु्ቚभቛኋमविति तिरो नहीሻ करनेगቛኋ।

ड. यमद स्ቌमि ्ቚቛኋलधिकቛኋरबी उपररो्ሹ खिण्ड (क) (खि) (ग) (घ) कने आधिቛኋर पर मविचቛኋररोपरቛኋन्ति आररोमपति कቛኋममिरकोሗ ककी तिदथर आधिቛኋर पर ्ቚरो्ቐति करनቛኋ उपयमु्ሹ समिझतिने हह तिरो उस दशቛኋ मिम मविभቛኋगबीय चयन सममिमति कने सቛኋमिनने मिቛኋमिलिने करो रखिቛኋ जनेयगቛኋ जरो आररोमपति कቛኋममिरक कने सम्पपूणिर अमभलिनेखिोሗ कने आधिቛኋर पर उसकने कቛኋयरवं कቛኋ मिपूल्यቛኋवंकन करनेगबी तिथቛኋ तिदथर रूप सने ्ቚरो्ቐमति द न ेने कने अथविቛኋ न द न ेने कने मविरय मिम अपनबी सवंस्ति म ुति दनेगबी।

च. यमद जቛኋवंच ्ቚशቛኋसनቛኋलधिकरणि आमद मकसबी अन्य एज न ेसबी दቛኋरቛኋ करቛኋई जቛኋ रहबी हरो तिरो उस दशቛኋ मिम उस एज न ेसबी कቛኋ परቛኋमिशर भबी इस मबन्दमु तिदथर आधिቛኋर पर ्ቚरो्ቐमति द न ेने पर ्ቚቛኋ्቎ मकयቛኋ जቛኋयनेगቛኋ।

छ. उपररो्ሹ ्ቚमቅኌयቛኋ कने उपरቛኋन्ति आररोमपति कቛኋममिरक कቛኋ तिदथर रूप सने ्ቚरो्ቐमति मकयने जቛኋनने कने आदनेशोሗ मिम यह स्प्ቖ मकयቛኋ जቛኋयनेगቛኋ मक ्ቚरो्ቐमति अमቇኌमि आदनेशोሗ तिक कने ललिए ककी जቛኋतिबी हह और शቛኋसन करो उ्ሹ तिदथर ्ቚरो्ቐमति करो कभबी भबी समिቛኋ्቎ कर द न ेने कቛኋ अलधिकቛኋर हह तिथቛኋ तिदनमुसቛኋर ऐसने कቛኋममिरक करो उस पर पर्ቚ त्यቛኋविमतिरति मकयቛኋ जቛኋ सकतिቛኋ हह लजस पद सने उसने ्ቚरो्ቐति मकयቛኋ गयቛኋ थቛኋ।

ज. तिदथर आधिቛኋर पर ्ቚरो्ቐमति आररोमपति कቛኋममिरक कने मविरु्ቍ चलि रहबी्ቚ शቛኋसनቛኋलधिकरणि ककी जቛኋवंच / मविभቛኋगबीय कቛኋयरविቛኋहबी अमभयरोजन आमद कने अनन्तिमि पररणिቛኋमि ्ቚቛኋ्቎ हरो जቛኋनने पर उसकने मविरय मिम उसबी ्ቚकቛኋर अमቇኌमि कቛኋयरविቛኋहबी ककी जቛኋयनेगबी, जहसबी ककी जቛኋतिबी हह यमद उसने तिदथर ्ቚ्ቐ मति न दबी गयबी हरोतिबी।

झ. यमद न्यቛኋयቛኋलिय दቛኋरቛኋ मकसबी तिदथर रूप सने ्ቚरो्ቐति कቛኋममिरक करो तिकनबीककी आधिቛኋर पर (गमुणिቛኋविगमुणि कने आधिቛኋर पर नहीሻ) दरोरमिमु्ሹ मकयቛኋ जቛኋतिቛኋ हह और न्यቛኋयቛኋलिय कने मनणिरय कने मविरु्ቍ अपबीलि यቛኋ उसबी आररोप कने ललिए मविभቛኋगबीय कቛኋयरविቛኋहबी कቛኋ ्ቚस्तिቛኋवि हह तिरो उस दशቛኋ मिम स्ቌमि ्ቚቛኋलधिकቛኋरबी इस मबन्दमु पर मविचቛኋर करगम मक आररोमपति कቛኋममिरक करो तिदथर ्ቚरो्ቐमति पर बनቛኋयने रखिቛኋ जቛኋय अथविቛኋ नहीሻ।"

"10. At the time of consideration of promotion by the Selection Committee to the employee facing charges for the first time and even after expiry of a year's period after adopting proceeding of sealed envelope; any period during which enquiry proceeding was delayed due to delinquent employee, shall not be considered in such period. If final outcome of the administrative enquiry, departmental proceedings/ prosecution is still to be received, the Selection Committee shall, in respect of the employees who are not under suspension, consider promotions to such employees on ad-hoc basis subject to the following conditions:

A. Whether charges levelled against the charged employee is serious to the extent that depriving him of promotion even in future shall be proper/ in public interest?

B. Whether considerable time will be required in receiving final outcome of the administrative enquiry/ departmental proceedings/ prosecution?

C. Whether the employee facing charges is directly or indirectly guilty of delay in administrative enquiry/ departmental proceedings/ prosecution?

D. Whether on the adhoc promotion being granted, the charged employee will misuse his position or adversely influence the enquiry?

E. If the competent authority, on the basis of aforesaid paras (a), (b), (c), (d) and after consideration, think it proper to grant adhoc promotion to the employees facing charges, in such a circumstance the matter shall be placed before the Departmental Selection Committee who shall evaluate work of the employee facing charges on the basis of his entire records and shall make its recommendation for granting or non-granting adhoc promotion.

F. If the enquiry is being conducted by the administrative authority or any other agency; in such a circumstance, opinion of the said agency shall also be taken into consideration for grant of ad-hoc promotion.

G. After the aforementioned procedure, it shall be made clear in the orders for the promotion of the charged employee that the promotion is being made till further order and the government has the right to cancel the aforesaid ad-hoc promotion at any time; and accordingly, such personnel as he can be reverted to the post from which he was promoted.

H. On getting the final report of the administrative inquiry/departmental proceeding being carried out against the charged personnel promoted on ad-hoc basis, further proceeding in this regard will be carried out in the same manner, as would have been done had he not been promoted on ad-hoc basis.

I. If the employee promoted on ad-hoc basis is acquitted of charges on technical grounds (not on merits) and an appeal against the order of the court or departmental proceeding is proposed, then in such a circumstance, the competent authority shall consider whether or not to retain the charged personnel on ad-hoc promotion." Counsel for petitioner submitted that seal cover procedure was adopted and the matter of petitioner was kept in seal cover, when other persons junior to him were promoted as stated in para-17, 18 and 19 and, therefore, after one year, the matter should have been examined in the light of aforesaid Government Orders.

Learned Standing Counsel fairly stated that if not already considered, petitioner's claim shall be considered by competent authority and appropriate order shall be passed by competent authority in accordance with law.

In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to competent authority to take a decision on the question of petitioner's ad-hoc promotion on the post of Head Constable in the light of Clause-10 of Government Order dated 28.05.1997. The authority concerned shall pass a speaking order within a period of two months from the date of production of a certified copy of this order before him.

It is made clear that this Court has not examined the applicability of aforesaid Government Order viz.-a-viz. the petitioner. The competent authority shall also be free to independently examine the applicability of the aforesaid Government Order and it shall thereafter pass a reasoned order, as directed above.
