Petitioner claims entitlement to promotional pay scale upon completion of 12 years of service, since selection grade was granted in the year 2006.

At present, the claim of the petitioner has not been adjudicated and appears to be pending before respondent no.1. That respondent appears to have called for report from authorised controller. The proceedings are still pending.

In view of the above, no useful purpose would be served in keeping the present petition pending or calling for a counter affidavit at this stage.

Accordingly, the present writ petition is disposed of with a direction, in case the petitioner files a copy of this order before respondent no.2 within a period of two weeks from today, the said respondent shall first call upon the authorised controller/respondent no.4 to make appropriate report on the claim made by the petitioner within a period of two weeks from the date of compliance shown by the petitioner. In case, the respondent no.4 refuses to act on the demand made by respondent no.1, the said respondent may proceed to verify the correct facts from his own record for causing such inspection on respondent no.4 as may be deemed necessary. That exercise may be completed within a period of two weeks therefrom.

In any case, a final reasoned and speaking order may be passed within a period of six weeks from the date of compliance shown by the petitioner.

Needless to add, any amount found payable, be paid out to the petitioner within a further period of two weeks therefrom.
