Heard Mr.Bhagwan Dutt Pandey, the learned counsel for petitioner and the learned standing counsel representing respondents.

Petitioner has approached this Court for a writ of mandamus commanding respondent-2 Nideshak, Nideshalaya Sainik Kalyan Evam Punarwash Uttar Pradesh Kariyappa Bhawan, Kaiserbagh, Lucknow to grant second ACP to petitioner upon completion of 16 years satisfactory service.

Present writ petition came up for admission on 25.02.2022 and this Court passed the following order:

"Learned Standing Counsel may obtain instruction by 15th April, 2022 as to why even after completion of 16 years of satisfactory service, petitioner, who is working as Junior Assistant, has not been given the benefit of second Assured Career Progression (A.C.P.), though by the order dated 2nd February, 2021, the Director, Directorate Sainik Welfare and Rehabilitation, Lucknow i.e. respondent no.2 has asked the authority concerned to take decision on the said aspect.

Put up this case on 15th April, 2022 as fresh."

Thereafter this writ petition again came up for admission on 18.04.2022 and Court passed following order:

"Learned Standing Counsel is granted three weeks and no more time to seek instruction in this matter.

List this case on 11.05.2022 as fresh.

Order Date :- 18.4.2022 "

Pursuant to aforesaid order dated 18.04.2022, the learned

Standing Counsel has received instructions in the matter. On basis thereof, he submits that on account of service record of the petitioner having been misplaced, the requisite decision could not be taken. He has however given an undertaking that since records of petitioner have been found, requisite decision shall be taken within a period of two months.

The court has no reason to disbelieve the undertaking given by learned Standing Counsel.

The writ petition is accordingly disposed of finally on the undertaking given by learned Standing Counsel.
