Heard Shri Sanjay Kumar, learned Advocate holding brief of Shri Shilpa Ahuja, learned counsel for the petitioner as well as learned Standing Counsel for respondents.
Learned Standing Counsel at the outset has raised an objection that the application given by the petitioner for grant of family pension as the petitioner is dependent of the deceased employee has already been rejected by the competent authority vide letter dated 25.02.2022 contained at page No. 71 of the writ petition. It is further submitted that the rejection order whereby the application of the petitioner has been rejected has not been challenged by the petitioner.
Learned counsel for the petitioner after arguing at some length has submitted that the petitioner be dismissed as withdrawn with liberty to file a fresh petition.
Accordingly, the petition is dismissed as withdrawn with liberty as prayed for.
