Joint Secretary U.P. Public Service Commission and Another Vs Aarti Yadav

Challenge in the present appeal is to the interim order dated March 10, 2022 passed by the learned Single Judge whereby the writ petitioner (respondent herein) was allowed to appear in the examination for recruitment as Lecturer, to be held on March 17, 2022 provisionally.

As the date of examination is already over and she has been permitted to appear in the examination, learned counsel for the appellants submitted that he may be permitted to withdraw the present appeal with liberty to raise all the issues before the learned Single Judge, as the counter affidavit has already been filed.

The appeal is, accordingly, dismissed as withdrawn with the liberty, as prayed for.
