This Habeas Corpus Writ Petition under Article 226 of the Constitution of India has been filed by 13 petitioners on the ground that they were engaged as labourers in brick kilns on certain conditions but neither the conditions have been fulfilled nor their payments have been done rather they have been compelled to work as bonded labourers, so the prayer to release them has been made through this writ petition.

Three orders passed by the coordinate benches of this court have been filed and it is argued that in the same cases the District Magistrate has been instructed to look into the matter.

Learned A.G.A. also has not opposed the same.

After hearing the learned counsel for the petitioners and learned A.G.A. for the State, I found that no contract/ agreement deed has been filed by the petitioners. As the prayer is made to get them released from the clutches of the respondent no. 4, in my opinion, it would be proper to instruct the District Magistrate to look into the matter. Hence, the District Magistrate concerned is directed to inquire into the matter and if the allegations of the petitioners are found to be correct, then action be taken against the respondent no. 4 and he shall get the labourers released from the clutches of the respondent no. 4 expeditiously without any unreasonable delay and if the allegations are found not correct then the respondent nos. 2 and 3 are directed to take action against the petitioners immediately after completion of the inquiry.

With the aforesaid observations, the writ petition is finally disposed of.

Learned A.G.A. shall ensure the compliance of this order.
