Heard Shri Deepak Kumar Pandey, learned counsel for the revisionist.
The revisionist has filed a revision against the judgment and order dated 07-05-2008 passed by the learned Additional Sessions Judge, Court No.8, Allahabad in S.T. No.24 of 2005 (State Vs. Manoj Kumar Pandey and Others), acquitting the accused-respondent nos.2 to 4.
The revisionist is the brother of the deceased and father of the deceased Shri Baij Nath Singh is alive.
During the life-time of the father, the brother would not fall within the definition of heirs of the deceased. Confronted with this situation, learned counsel for the revisionist states that the father of the deceased is not keeping good health and that was the reason for the brother to file the instant revision. However, he does not want to press the revision and father of the deceased will file a fresh revision challenging the impugned order dated 07-05-2008.
Accordingly, the instant revision is dismissed as not pressed.
