Heard learned counsel for the petitioner and learned A.G.A. Perused the record.
This criminal writ petition under Article 226 of the Constitution of India has been filed seeking the quashing of impugned externment order dated 29.9.2021 passed by the Additional District Magistrate, Finance & Revenue, Sant Kabir Nagar in Case No.39 of 2021 under Section 3/4 of U.P. Control of Goondas Act as well as order dated 23.2.2022 passed by the Commissioner, Basti Division, Basti whereby the Appeal No.605 of 2021 (Mahbub vs State) against the externment order dated 29.9.2021 has been dismissed.
Since the order of externment has already been given effect to and the petitioner has already undergone six months externment period and its appeal too has been decided on merit. Under the circumstances, for all practical purposes this criminal misc. writ petition has rendered infructuous.
Accordingly, this writ petition stands dismissed as infructuous.
