Although prayer is made in the writ petition to quash the first information report in Case Crime No. 045 of 2022, under Sections 144 and 295-A I.P.C. Police Station Munderwa District Basti, but learned counsel for the petitioner states that the petitioner does not intend to press such prayer. The only grievance pressed is against the local police personnel contained in Annxure-3 to the writ petition.
We are informed that an application under Section 156 (3) Cr.P.C. is filed and is pending in that regard before the concerned magistrate. We, therefore, refrain from making any observation in that regard when the concerned magistrate is ceased of the issue.
Writ petition, accordingly, is consigned to record.
