Personal affidavit filed on behalf of Commissioner of Police, Lucknow is taken on record.
Shri Shashank Kumar, learned counsel for the petitioner and Ms. Meera Tripathi, learned AGA for State-respondent are present.
From the perusal of the affidavit of the Commissioner of Police, Lucknow it transpires from paragraph 11 of the said affidavit that one of the accused- Shanker Singh has already died on 26.04.2017 during the pendency of the investigation. Further, paragraph 15 of the affidavit states that name of respondent no.4- Parmeshwar Das Chela has been dropped from the array of accused and copy of Final Report dated 17.08.2021 dropping the name of respondent no.5 has been annexed as Annexure no.5 to the affidavit. Lastly, paragraph no.16 of the affidavit states that investigation has been concluded and charge sheet has been submitted on 25.07.2019 to the authority concerned against respondent no.5- Shri Pal Yadav and other two coaccused persons, namely, Ashok Kumar Yadav and Prabhakar Yadav.
In view of the aforesaid submissions made by learned AGA, the matter is consigned to record.
