As per office report dated 24.08.2022, notice upon the appellant could not be served as the appellant has died on 20.08.1994. In this connection, the C.J.M.-Etah has annexed with his report, the death certificate issued by Sabhasad, Ward No.03, Mahapalika Parishad, Etah, statements of serving officer S.I.Gajraj Singh, Ram Avatar, s/o Subedar and Meena w/o Ram Avatar, Muhar Pal Singh s/o Sadhuram Singh.
In above circumstances, it is proved that the sole appellantSubedar has died and, therefore, the appeal is dismissed as abated.
The bail bond is cancelled and sureties are discharged.
Let lower court record be returned to the court concerned.
