Learned counsel for the appellants has filed supplementary affidavit today in Court, which is taken on record.

Heard learned counsel for the appellants, learned AGA for the State, Shri Shakil Ahmad, learned counsel for the respondent no.2 and perused the record.

This criminal appeal has been filed by the appellants with the prayer to quash the summoning order dated 15.04.2021 as well as entire proceedings of Criminal Complaint Case No. 14 of 2021 (Jai Prakash Vs. Nitin Saini and others), under Sections 366, 120-B IPC and Section 3(2)5 of SC/ST Act, Police Station Nagina Dehat, District Bijnor, pending in the court of Special Judge (SC/ST Act), Bijnor.

After some arguments, learned counsel for the appellants has made a statement at the bar that he does not want to press other prayers made in the prayer clause of the appeal and has confined his prayer only to the relief that in case, appellants move an application for bail before the court below, their bail application be considered and disposed of at the earliest.

Per contra, learned AGA has opposed for expeditious disposal of bail application of the appellants.

In view of the above statement, it is directed that if the appellants move an application for bail before the court below, their prayer for bail be considered and decided expeditiously in accordance with law.

With the aforesaid observations, this criminal appeal is finally disposed of.
