Heard Sri S.P. Singh Somvanshi, learned counsel for the applicant and Sri Mohit Jauhari, learned Additional Chief Standing Counsel and perused the record.
Learned counsel for the applicant submits that neither the continuity of service nor the arrears of salary was given to the applicant.
Learned counsel for the respondent submits that award was allowed in favour of the applicant by the Labour Court by setting aside the termination order since 1.1.1999 and directed to reinstate the applicant with the continuity of services on his post and thereafter, State has filed Writ Petition No.1713 (M/S) of 2013, which was dismissed vide order dated 17.5.2018, thereafter, Writ Petition No. 1997 (S/S) of 2013 is also filed by the petitioner with a prayer to execute the award dated 28.6.2010 passed by the Labour Court, Allahabad and this petition was also disposed of on the same date.
On 17.5.2018, Writ Petition No.1713/2013 was dismissed and the direction of of the writ court is already complied with by the competent authority by passing order dated 13.11.2019 and 4.12.2019 annexed with the affidavit of compliance dated 9.12.2019, aforesaid order clearly reveals that the petitioner was allowed to work as Beldar.
Considering the submissions of learned counsel for the applicant as well as learned Additional Chief Standing Counsel, no contempt is made out and the same is hereby dismissed .
