On 30.08.2022, following order was passed:-
"Learned counsel for the applicant is permitted to implead Aparna U., Mission Director, National Health Mission, U.P. Lucknow as respondent no.3 forthwith.
Issue notice to opposite parties no. 1 and 3.
List this case on 09.11.2022.
In case the order of writ court has not been complied with, the opposite parties no.1 and 3 shall appear in person before this Court on the next date fixed.
The officer who is present today in Court, need not to appear again."
Mr. Neerav Chitravanshi, learned counsel for the opposite party no.3 and Sri Manish Mishra, learned Standing Counsel have filed affidavit of compliance, which are taken on record.
Mr. Neerav Chitravanshi, learned counsel for the opposite party no.3 has submitted that vide order dated 07.01.2022, a direction was issued to the respondent that in case any representation is moved by the petitioner, the same shall be considered and decided by reasoned and speaking order. He further submitted that the representation of the petitioner is already decided by the Chairman, District Health Society, Gonda vide order dated 20.10.2022. Therefore, the present contempt application has lost its efficacy.
Considering the arguments of learned counsel for the parties and going through the contents of the affidavits of compliance filed by Sri Neerav Chitravanshi, learned counsel for the opposite party no.3 as well as Sri Manish Mishra, learned Standing Counsel, the present contempt application is dismissed as having become infructuous.
However, it is open to the applicant to avail appropriate remedy, if he is having any grievance against the competent authority.
