Learned counsel for the applicant has filed a status report relating to the bail order of co-accused Kuldeep, passed by another co-ordinate bench of this Court vide of date passed in Criminal Misc. Bail Application No. 57881 of 2022. It is taken on record.
This is an application for bail on behalf of the applicant Amardeep in Case Crime No. 231 of 2021, under Sections 379 and 411 I.P.C., Police Station Bilari, District Moradabad.
Heard learned counsel for the applicant and the learned A.G.A. appearing for the State.
The submission of the learned counsel for the applicant is that he is innocent and has been falsely implicated in the present crime with ulterior motive. The applicant is not named in the FIR. The name of the applicant has been surfaced in the crime on the basis of alleged recovery of five motorcycles from the joint possession of the applicant and other co-accused persons. It is submitted that the applicant has no criminal antecedents to his credit. It is fairly submitted that after arrest in the present case, six more cases have been registered against the applicant which have been explained in paragraph no. 9 of the affidavit filed in support of the bail application. It is submitted that except the cases registered after arrest in the present case, the applicant has no criminal antecedents to his credit.
