A copy of the order dated 28.11.2022 relating to Neenukiya passed by coordinate bench of this Court in Criminal Misc. Bail Application No. 54067 of 2022 has been produced by learned counsel for the applicant, which is taken on record.

Heard Sri Dinesh Kumar Shukla, learned counsel for the applicant and Sri Luxman Prasad, learned AGA appearing for the State.

This is an application for bail on behalf of the applicant Pappu in connection with Case Crime No. 172 of 2022, under Section 3/5/8 of Cow Slaughter Act, Police Station Sahawar, District Kasganj.

The submission of the learned counsel for the applicant is that the applicant is innocent and has been falsely implicated in the present case. It is also submitted that the applicant accused was not arrested on the spot. Neither any equipment of cow slaughter was recovered from the possession of the applicant nor any flesh has been recovered from him. It is next submitted that applicant has criminal history of two cases which has duly been explained in para 3 of the supplementary affidavit. It is further submitted that co-accused, Neenukiya, identically circumstanced as the applicant has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 28.11.2022 passed in Criminal Misc. Bail Application No. 54067 of 2022 entitling the applicant to be released on bail on the ground of parity. It is in the last submitted that the applicant is in jail since 22.07.2022 and in case the applicant is released on bail, he will not misuse the liberty of bail.
