recovered on 23.06.2021. Thereafter, the statement of prosecutrix was recorded by Investigating Officer under section 161 Cr.P.C. Same is on record as Annexure-2 to the affidavit. The prosecutrix in her aforesaid statement has not supported the prosecution story as unfolded in the F.I.R. To the contrary, it has been stated by her that she is aged about 19 years. On 28.05.2021 at around 10:30 am, she herself came out of her home and out of her own sweet will went to Anand Vihar, Delhi by bus alone. She thereafter contacted the applicant Rahul on telephone. In the dialogue which took place in between the prosecutrix and the applicant, prosecutrix insisted of her staying with the applicant. Ultimately, on 12.06.2021, the prosecutrix and the applicant solemnized their marriage at Arya Samaj Temple, Badaun. Subsequent to above, the prosecutrix was medically examined. Her medico legal report is on record as Annexure-3 to the affidavit. The doctor, who medically examined the prosecutrix did not found any injury on the body of prosecutrix so as to denote the commission of sexual assault. Certain samples were taken from the body of prosecutrix for pathological examination. However, the supplementary medico legal report of the prosecutrix has not been brought on record. As per the medical opinion, the age of the prosecutrix was determined to be about 18 years. Ultimately, the statement of prosecutrix was recorded under section 164 Cr.P.C. Same is on record as Annexure-4 to the affidavit. In her aforesaid statement, prosecutrix has reiterated her earlier statement under section 161 Cr.P.C.
