It has been argued by learned counsel for the applicant that applicant is innocent and he has been falsely implicated in the present case. The applicant is brotherin-law (devar) of deceased. The marriage of deceased with brother of applicant has taken place about eight years prior to the incident. The allegations that applicant and co-accused persons used to harass the deceased, are thoroughly false. Learned counsel has referred the statement of son of deceased and other witnesses and submitted that there was some dispute between deceased and her husband and she committed suicide due to that reason. The applicant has nothing to do with matrimonial life of deceased. Referring to facts of the matter, it was submitted that there is no evidence that applicant has abetted or instigated the deceased to commit suicide. Further, co-accused Sankata Prasad, who is fatherin-law of deceased, has already been granted bail by co-ordinate Bench of this Court vide order dated 03.11.2022, passed in Criminal Misc. Bail Application No. 39699 of 2022, copy of which is available on record. Lastly, it was submitted that the applicant is languishing in jail since 30.04.2022, having no criminal history and that in case the applicant is released on bail, he will not misuse the liberty of bail and will cooperate in trial.
