Heard learned counsel for the applicant and learned A.G.A. for the State and perused the material brought on record.
The present bail application has been filed on behalf of the applicant, Israr, with a prayer to release him on bail in Case Crime No. 358 of 2022, under Sections 307, 429 I.P.C. and 3/5क/5- ख/8 Cow Slaughter Act, Police Station- Kokhraj, DistrictKaushambi, during pendency of trial.
The submission advanced by learned counsel for the applicant is that the applicant is innocent and has been falsely implicated in the present case due to ulterior motive. No offence under Sections U.P. Prevention of Cow Slaughter Act, 1955 has been committed by him warranting punishment under the aforesaid Act. It is also contended that the applicant is only the driver of the vehicle and no beef has been recovered from the possession of the applicant. It has also been submitted that it is a no injury case, neither any police personnel nor the accused has been injured in the alleged firing. It has also been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required and is also ready to accept all the conditions which the Court may deem fit to impose upon him. It is further contended by learned counsel for the applicant that the applicant is languishing in jail since 09.06.2022.
