- Heard Sri Manish Kumar, the learned counsel for the applicant, Sri Jai Kishan Chaurasia, the learned Additional Government Advocate, Sri Shiv Prakash, the learned counsel for the informant and perused the record.
- The instant application has been filed seeking release of the applicant on bail in Case Crime No. 87 of 2022, under Sections 323, 352, 504, 506, 354-B & 452 IPC, Police Station Dilari, District Moradabad during pendency of the trial in the Court below.
- The aforesaid case has been registered on the basis of an F.I.R. lodged on 17.04.2022 against 6 named accused persons, including the applicant, alleging that the co-accused Naeem @ Nadeem has proposed to marry the informant but ultimately he did not marry her. It is alleged that on 25.01.2022, all the other accused persons entered the informant's house, abused her, beaten her up and the applicant indulged into committing obscene activities with the informant and all the accused persons had torn away her clothes. Although the incident is alleged to have taken place on 25.01.2022, FIR was lodged on 17.04.2022 and there is absolutely no explanation for the delay in lodging of the FIR.
