Sri Arun Kumar Pandey, the learned AGA states that the Hon'ble Supreme Court has granted interim bail to the applicant by means of an order dated 30.09.2022 passed in SLP No. 8998 of 2022 after taking into consideration the fact that the applicant has deposited an amount of Rs. 35 lacs to establish his bonafide, the interim bail has been granted to the applicant for a period of six months in order to explore the possibility of making payment to depositors and the matter has been directed to be listed after a period of six months.
Since the Hon'ble Supreme Court is already seized of matter after granting interim bail to the applicant, nothing remains to be decided by this Court.
The application has become infructuous due to the Hon'ble Supreme Court having granted interim bail to the applicant and being seized of the matter already.
In view of the aforesaid situation, the instant application is rejected as having become infructuous.
It goes without saying that in case of any subsequent developments, the rejection of the instant application having become infructuous would not affect the rights of the applicant.
