Heard learned counsel for the applicant, learned A.G.A for the State and perused the record.
It is submitted that in this case general allegation has been made against the applicant to make an attempt for possessing the property of informant unlawfully with coaccused person. It is further submitted that co-accused Rajendra Singh has already been granted bail by coordinate Bench of this Court in Crl. Misc. Bail Application No.4295 of 2022. vide order dated 14.2.2022 and the case of applicant is on similar footing to that of co-accused. The applicant is in jail since 26.10.2021. In case he is released on bail, he will not misuse the liberty of bail. Therefore, requested for bail.
On the other hand, learned AGA opposed the prayer for bail.
Considering the facts and circumstances of the case, nature of allegation and evidence on record and the fact that coaccused has already been granted bail by co-ordinate Bench of this Court and the case of applicant is on similar footing to that of co-accused and without expressing any opinion on the merits of the case, the Court is of the view that the applicant has made out a case for bail. The bail application is allowed .
