The complainant has filed an application under Section 482 CrPC, and thereafter, the first information report of this was lodged in pursuant to order dated 06.09.2017, passed by this court in application under Section 482 CrPC No.11860/2016. During investigation, the matter was referred to CBCID for investigation, but after investigation, CBCID has submitted final report. Learned counsel submitted that after thorough investigation, police have submitted final report with conclusion that incident is doubtful and thereafter, the applicant and co-accused person have been summoned on protest petition filed by the complainant, which was registered as a complaint case. Applicant and co-accused persons have also filed a petition under Article 227 No.-2661/2022 against the summoning order, which is pending before this Court. Referring to the facts of the matter and statement of prosecutrix, it was submitted that there are material contradictions and the allegations of rape are thoroughly improbable. The applicant has no criminal antecedents. The applicant undertake to cooperate during trial and he would appear as and when required by the Court. It has been stated that in case, applicant is granted anticipatory bail, he shall not misuse the liberty of bail and will co-operate during trial and would obey all conditions of bail.
