Heard learned counsel for the applicants and learned AGA for the State.

Present petition has been preferred by the applicants for quashing the cognizance order dated 02.08.2019 as well as the charge sheet No.172/19 dated 08.06.2019 filed in Case Crime No.1027 of 2018, Under Section 354(Ka), 323, 506 I.P.C., Police Station - Jagdishpura, District - Agra and the criminal proceedings initiated on the basis of the aforesaid charge sheet vide Criminal Case No.1642 of 2019, under Section 323, 506 I.P.C., pending in the Court of Judicial Magistrate - 1, Agra.

After arguing at some length, learned counsel for the applicants/petitioners has submitted that liberty may be given to the applicants/petitioners for moving a discharge application before the court below.

Learned AGA as well as Sri Vipin Chandra Pandey, learned counsel for Opposite Party No.2 has no objection to the prayer made by learned counsel for the applicants/petitioners.

The present petition is disposed of with liberty to the applicants/petitioners to move discharge application before the court below within a period of fifteen days and the same shall be decided expeditiously in accordance with law.
