Heard the learned counsel for the applicants and the learned A.G.A. for the State and perused the record.

Learned counsel for the applicants appears and submitted that the parties have arrived at a compromise, so he wants to get his case compounded in the lower court in the light of judgment of Damodar S. Prabhu Vs. Sayed Babalal H., (2010) 5 SCC 663 , hence, his case be relegated to the trial court.

Though, the other party is not before the court but as the learned counsel for the applicants prayed to get his case compounded in the light of judgement of Damodar S. Prabhu Vs. Sayed Babalal H (supra), the present application under section 482 Cr.P.C. is disposed of with the direction that in case the applicants move an application within 15 days from today before the trial court in this regard, the trial court shall decide the matter expeditiously preferably within a period of four months from the date of production of the certified copy of this order before it.

If the applicants do not move any application for compounding of the offence within stipulated time as per direction of this court or want to face trial, the trial court shall be at liberty to proceed in the matter in accordance with law against the accused persons.
