The only prayer made by the applicant is that a direction be issued to the C.J.M., Auraiya to decide the Case No. 405 of 2011 (Old No. 359 of 2009) (State Vs. Siyaram and others) arising out of Case Crime No. 155 of 2008, under section 147, 341, 353 IPC and 7 Criminal Law Amendment Act, P.S. Phaphund, District Auraiya within the stipulated period.
Considering the facts and circumstances of the case and without expressing any opinion on the merits of the case, this application under section 482 Cr.P.C. is finally disposed of with a direction to the C.J.M., Auraiya to decide the Case No. 405 of 2011 (Old No. 359 of 2009) (State Vs. Siyaram and others) arising out of Case Crime No. 155 of 2008, under section 147, 341, 353 IPC and 7 Criminal Law Amendment Act, P.S. Phaphund, District Auraiya in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of ten months from the date of production of certified copy of this order, if there is no legal impediment.
