details of the mobile of Ansh Singh and Aditya Singh while the prosecution case is that Ansh Singh was called through a phone call by Aditya Singh. Further that there is no evidence under section 504 IPC against the applicants. No evidence has been collected regarding motive of the incident. Further that in parcha no. 27 of SCD, witnesses Dayashankar Singh, Vinod Rai, Anand Kumar Singh and Pawan Singh have clearly stated that at the time of the incident accused Virendra Singh alias Bittu Singh and Aditya Singh were not present there. They were present at a marriage hall and were seen there by the aforesaid witnesses. In the parcha no.29 of SCD, the witnesses Rama Shankar, Pramod Kumar Pandey, Satyam Shukla, Shailendra Singh and Arvind have stated that there was a dispute of Ansh Singh with some school boys and Ansh Singh brutally assaulted one of the boys, Ansh Singh left his school and those boys were searching him to take revenge. Hence there is probability that Ansh Singh should have been assaulted by those boys. Further the statement of injured Himanshu Singh has been recorded twice but even then his statement is incomplete which is evident from the case diary. On the aforesaid grounds, the prayer was made for further investigation of the case. Learned Magistrate by the impugned order dated 23.03.2021 has rejected the aforesaid application. The applicants-accused preferred a revision no.105 of 2021 which has also been dismissed by the Additional Sessions Judge, court no.3 vide order dated 15.03.2022.
