The present application u/s 482 has been filed for quashing the impugned order dated 29.7.2020 passed by the learned Civil Judge (Senior Division)/FTC-Ist/A.C.J.M., Deoria in Misc. Case No. 24 of 2020 (Bansh Bahadur Dubey vs. Rahul Mishra and others) and the impugned order dated 21.10.2020 passed by the learned Sessions Judge, Deoria in Criminal Revision No. 80 of 2020 (Bansh Bahadur Dubey vs. State).
Learned counsel for the applicant has limited his prayer to the extent that impugned order dated 29.7.2020 whereby the application under Section 156(3) Cr.P.C. was considered to be a complaint and the matter was put up for the statements under section 200 and 202 Cr.P.C., however, till date, nothing has happened. Even the file was missed and prayed that the recording of statements be done in a time bound period.
Considering the above submission that speedy trial is right of the complainant also.
Let further proceedings in pursuance of the order dated 29.7.2020 be completed i.e. recording of statement under sections 200 and 202 Cr.P.C. within a period of three weeks from today by the trial court.
The application u/s 482 Cr.P.C. is disposed of.
